2. hosting & content delivery networks (CDN) - Shopify

We host our website at Shopify International Limited, Victoria Buildings, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland (hereinafter: "Shopify").

Shopify is a tool for creating and hosting websites. When you visit our website, Shopify collects your IP address and information about the device you are using and your browser. Shopify is also used to analyze visitor numbers, visitor sources and customer behavior and to generate user statistics. When you make a purchase on our website, Shopify also collects your name, e-mail address, delivery and billing addresses, payment details and other data related to the purchase (e.g. telephone number, amount of sales made, etc.). Shopify stores cookies in your browser for analysis purposes.

You can visit www.prettynamnam.de and find out about our company and our products without providing any personal details. We do not store any personal data in this context. During your visit to our site, you remain anonymous and the connection data transmitted by your Internet browser each time you visit our site, such as the date, the time spent on the site or the name of your Internet service provider, are used by us without any personal reference and evaluated using certain analysis tools such as Google Analytics (see below).

Every time you use the Internet, certain information is automatically transmitted by your Internet browser and stored by us in so-called log files. The log files are stored by us exclusively for the purpose of investigating faults and for security reasons (e.g. to clarify attempted attacks). Log files whose further storage is required for evidence purposes are excluded from deletion until the respective incident has been finally clarified and may be passed on to investigating authorities in individual cases. Purely statistical processing or evaluation is carried out in accordance with Art. 6 para. 1 lit. f GDPR on the basis of our legitimate interest in improving the stability and functionality of our website. This data is not passed on, merged with other data sources or used in any other way. However, we reserve the right to check the server log files retrospectively if there are concrete indications of illegal use.

      We collect personal data only to the extent provided by you. You provide personal data voluntarily, e.g. when you place an order, subscribe to our newsletter or use similar functions. Insofar as we collect data from you, this only takes place within the framework of German and European data protection law.

      Personal data are individual details about personal or factual circumstances of an identified or identifiable natural person. The processing and use of personal data takes place for the purpose of fulfilling and processing the contractually agreed services - the delivery of your ordered goods and the associated payment - as well as for processing your inquiries.

An authorization exists if the transfer is necessary for the purpose of contract processing or for billing purposes or for the collection of the payment (further information in the section "Payment processing") or if you have expressly consented.       If you have provided us with your email address when purchasing goods or services, we reserve the right to regularly send you offers for similar goods or services to those you have already purchased from our range by email.     2. Newsletter distribution via Klaviyo

      We use Klaviyo, an email marketing service, on our website.

      The service provider is the U.S. company Klaviyo, 125 Summer St, Boston, MA 02110, USA.

      Klaviyo processes your data, including in the United States. Klaviyo is an active participant in the EU-US Data Privacy Framework, which regulates the proper and secure transfer of personal data from EU citizens to the United States.     3. WhatsApp Newsletter When you sign up for our WhatsApp newsletter, we will regularly send you information about our offers via WhatsApp. The only required information for receiving the newsletter is your mobile phone number.

      To receive the newsletter, add the mobile phone number we provided to your mobile device’s contacts and send us the message “Start” via WhatsApp. By sending this WhatsApp message, you grant us your consent to the use of your personal data in accordance with Art. 6(1)(a) GDPR for the purpose of sending the newsletter. We will then add you to our newsletter distribution list.

      The data we collect when you sign up for the newsletter is processed exclusively for the purpose of sending you promotional communications via the newsletter. You can unsubscribe from the newsletter at any time by sending us the message “Stop” via WhatsApp. Once you have unsubscribed, your email address will be immediately deleted from our newsletter distribution list, unless you have expressly consented to further use of your data or we reserve the right to use your data for other purposes that are permitted by law and about which we inform you in this statement.

      Please note that WhatsApp gains access to the address book of the mobile device we use to send the newsletter and automatically transfers phone numbers stored in the address book to a Facebook server in the U.S.

      For sending our WhatsApp newsletter, we therefore use a mobile device whose address book contains only the WhatsApp contact information of our newsletter recipients. This ensures that every person whose WhatsApp contact details are stored in our address book has already consented to the transfer of their WhatsApp phone number from the address books of their chat contacts in accordance with Art. 6(1)(a) GDPR by accepting the WhatsApp Terms of Service when first using the app on their device. The transmission of data from users who do not use WhatsApp and/or have not contacted us via WhatsApp is therefore excluded.

      Facebook Inc., as the owner of WhatsApp and headquartered in the U.S., is certified under the U.S.-EU Privacy Shield framework, which ensures compliance with the data protection standards applicable in the EU.

      On the basis of our legitimate interest in personalized direct advertising, we reserve the right to store your first and last name, your postal address and - insofar as we have received this additional information from you as part of the contractual relationship - your title, academic degree, year of birth and your professional, industry or business name in accordance with Art. 6 para. 1 lit. f GDPR and to use them to send you interesting offers and information about our products by post.

      You can object to the storage and use of your data for this purpose at any time by sending a corresponding message to the controller.

      If you contact us by email or telephone - e.g. to find out about our products, ask general questions or make complaints - your data and details provided will be forwarded to us via our provider and may be stored by us digitally or offline. The information you provide will remain with us until you ask us to delete it, revoke your consent to storage or the purpose for data storage no longer applies (e.g. after your request has been processed). Mandatory statutory provisions - in particular retention periods - remain unaffected.

      Your inquiry will only be processed by our authorized service employees. Your data will not be used for any other purpose or passed on to third parties. A comparison with personal data that we may have collected elsewhere will only be made if it is useful for the speedy clarification of your request.

      Personal data is collected when you contact us (e.g. by contact form, email or telephone). Which data is collected in the case of a contact form can be seen from the respective contact form. This data is stored and used exclusively for the purpose of responding to your request or for contacting you and the associated technical administration. The legal basis for the processing of this data is our legitimate interest in responding to your request in accordance with Art. 6 para. 1 lit. f GDPR. If your contact is aimed at concluding a contract, the additional legal basis for the processing is Art. 6 para. 1 lit. b GDPR. Your data will be deleted after final processing of your request. This is the case if it can be inferred from the circumstances that the matter in question has been conclusively clarified and provided that there are no statutory retention obligations to the contrary.

      We cannot guarantee complete data security when communicating by email.

    2. WhatsApp Business

      We reserve the right to offer visitors to our website, as well as customers and interested parties, the opportunity to contact us via the WhatsApp messaging service provided by Facebook Inc., 1 Hacker Way, Menlo Park, CA 94025, USA. In such cases, we use the so-called “Business version” of WhatsApp.

      If you contact us via WhatsApp in connection with a specific transaction (such as a completed order), we will store and use the mobile phone number you use on WhatsApp, as well as your first and last name (if provided), in accordance with Article 6(1)(b) of the GDPR to process and respond to your inquiry. Based on the same legal basis, we may ask you via WhatsApp to provide additional data (order number, customer number, address, or email address) so that we can assign your inquiry to a specific transaction.

      If you use our WhatsApp contact for general inquiries (such as regarding our range of services, availability, or our website), we will store and use the mobile phone number you use on WhatsApp as well as—if provided – your first and last name in accordance with Art. 6(1)(f) GDPR based on our legitimate interest in the efficient and timely provision of the requested information.

      Your data will always be used solely to respond to your inquiry via WhatsApp. It will not be shared with third parties.

      Please note that WhatsApp Business gains access to the address book of the mobile device we use for this purpose and automatically transfers phone numbers stored in the address book to a Facebook server in the United States. To operate our WhatsApp Business account, we use a mobile device whose address book contains only the WhatsApp contact information of users who have contacted us via WhatsApp.

      This ensures that every person whose WhatsApp contact details are stored in our address book has already consented to the transfer of their WhatsApp phone number from the address books of their chat contacts in accordance with Art. 6(1)(a) GDPR by accepting the WhatsApp Terms of Service when first using the app on their device. The transmission of data from users who do not use WhatsApp and/or have not contacted us via WhatsApp is therefore excluded.

7. data processing when opening a customer account and for contract processing

In accordance with Art. 6 para. 1 lit. b GDPR, personal data will continue to be collected and processed if you provide it to us for the execution of a contract or when opening a customer account. Which data is collected can be seen from the respective input forms. Deletion of your customer account is possible at any time and can be done by sending a message to the above-mentioned address of the controller. We store and use the data provided by you to process the contract. After complete processing of the contract or deletion of your customer account, your data will be blocked with regard to retention periods under tax and commercial law and deleted after expiry of these periods, unless you have expressly consented to further use of your data or we have reserved the right to further use of your data as permitted by law, about which we will inform you accordingly below.

 

8. data processing and forwarding for order processing

We only transfer personal data to third parties if this is necessary in the context of contract processing, for example to the companies entrusted with the delivery of the goods or the credit institution commissioned with payment processing. Any further transmission of the data will not take place or will only take place if you have expressly consented to the transmission. Your data will not be passed on to third parties without your express consent, for example for advertising purposes.

The basis for data processing is Art. 6 para. 1 lit. b GDPR, which permits the processing of data for the fulfillment of a contract or pre-contractual measures.

In addition, we are entitled to pass on personal data for debt collection purposes and reserve the right to exchange data with business protection organizations (e.g. Schufa). Furthermore, we do not rule out the possibility of transmitting anonymized usage data for market research purposes. The identification of users is excluded.

We would like to point out that we are obliged to provide information about data in individual cases by order of the competent authority, insofar as this is necessary for the purposes of criminal prosecution, to avert danger by the police authorities of the federal states, to fulfill the legal tasks of the federal and state constitutional protection authorities, the Federal Intelligence Service, the Military Counter-Intelligence Service or to enforce intellectual property rights.

    1. Shipping processing

      To process your order, we work together with the following service provider(s), who support us in whole or in part in the execution of concluded contracts. Certain personal data will be transmitted to these service providers in accordance with the following information.

      The personal data collected by us will be passed on to an external fulfillment service provider who packs our parcels (you are welcome to ask us at any time for the exact company address of the service provider currently commissioned), as well as to the transport company commissioned with the delivery, insofar as this is necessary for the delivery of the goods.

      We pass on your payment data to the commissioned credit institution as part of payment processing, insofar as this is necessary for payment processing.       Bei Auswahl der Zahlungsart "Amazon Pay" erfolgt die Zahlungsabwicklung über den Zahlungsdienstleister Amazon Payments Europe s.c.a., 38 avenue J.F. Kennedy, L-1855 Luxemburg (im Folgenden: „Amazon Payments“), an den wir Ihre im Rahmen des Bestellvorgangs mitgeteilten Informationen nebst den Informationen über Ihre Bestellung gemäß Art. 6 Abs. 1 lit. b DSGVO weitergeben. Die Weitergabe Ihrer Daten erfolgt ausschließlich zum Zweck der Zahlungsabwicklung mit dem Zahlungsdienstleister Amazon Payments und nur insoweit, als sie hierfür erforderlich ist.       2.2 Apple Pay

      Wenn Sie sich für die Zahlungsart „Apple Pay“ der Apple Distribution International (Apple), Hollyhill Industrial Estate, Hollyhill, Cork, Irland, entscheiden, erfolgt die Zahlungsabwicklung über die „Apple Pay“-Funktion Ihres mit iOS, watchOS oder macOS betriebenen Endgerätes durch die Belastung einer bei „Apple Pay“ hinterlegten Zahlungskarte. Apple Pay verwendet hierbei Sicherheitsfunktionen, die in die Hardware und Software Ihres Geräts integriert sind, um Ihre Transaktionen zu schützen. Für die Freigabe einer Zahlung ist somit die Eingabe eines zuvor durch Sie festgelegten Codes sowie die Verifizierung mittels der „Face ID“- oder „Touch ID“ – Funktion ihres Endgerätes erforderlich.

      Zum Zwecke der Zahlungsabwicklung werden Ihre im Rahmen des Bestellvorgangs mitgeteilten Informationen nebst den Informationen über Ihre Bestellung in verschlüsselter Form an Apple weitergegeben. Apple verschlüsselt diese Daten sodann erneut mit einem entwicklerspezifischen Schlüssel, bevor die Daten zur Durchführung der Zahlung an den Zahlungsdienstleister der in Apple Pay hinterlegten Zahlungskarte übermittelt werden. Die Verschlüsselung sorgt dafür, dass nur die Website, über die der Einkauf getätigt wurde, auf die Zahlungsdaten zugreifen kann. Nachdem die Zahlung getätigt wurde, sendet Apple zur Bestätigung des Zahlungserfolges Ihre Geräteaccountnummer sowie einen transaktionsspezifischen, dynamischen Sicherheitscode an die Ausgangswebsite.

      Sofern bei den beschriebenen Übermittlungen personenbezogene Daten verarbeitet werden, erfolgt die Verarbeitung ausschließlich zum Zwecke der Zahlungsabwicklung gemäß Art. 6 Abs. 1 lit. b DSGVO.

      Apple bewahrt anonymisierte Transaktionsdaten auf, darunter der ungefähre Kaufbetrag, das ungefähre Datum und die ungefähre Uhrzeit sowie die Angabe, ob die Transaktion erfolgreich abgeschlossen wurde. Durch die Anonymisierung wird ein Personenbezug vollständig ausgeschlossen. Apple nutzt die anonymisierten Daten zur Verbesserung von „Apple Pay“ und anderen Apple-Produkten und Diensten.

      Wenn Sie Apple Pay auf dem iPhone oder der Apple Watch zum Abschluss eines Kaufs verwenden, den Sie über Safari auf dem Mac getätigt haben, kommunizieren der Mac und das Autorisierungsgerät über einen verschlüsselten Kanal auf den Apple-Servern. Apple verarbeitet oder speichert keine dieser Informationen in einem Format, mit dem Ihre Person identifiziert werden kann. Sie können die Möglichkeit zur Verwendung von Apple Pay auf Ihrem Mac in den Einstellungen Ihres iPhone deaktivieren.       2.3 Google Pay

      Wenn Sie sich für die Zahlungsart „Google Pay“ der Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Irland („Google“) entscheiden, erfolgt die Zahlungsabwicklung über die „Google Pay“-Applikation Ihres mit mindestens Android 4.4 („KitKat“) betriebenen und über eine NFC-Funktion verfügenden mobilen Endgeräts durch die Belastung einer bei Google Pay hinterlegten Zahlungskarte oder einem dort verifizierten Bezahlsystem (z.B. PayPal). Für die Freigabe einer Zahlung über Google Pay in Höhe von mehr als 25,- € ist das vorherige Entsperren Ihres mobilen Endgerätes durch die jeweils eingerichtete Verifikationsmaßnahme (etwa Gesichtserkennung, Passwort, Fingerabdruck oder Muster) erforderlich.

      Zum Zwecke der Zahlungsabwicklung werden Ihre im Rahmen des Bestellvorgangs mitgeteilten Informationen nebst den Informationen über Ihre Bestellung an Google weitergegeben. Google übermittelt sodann Ihre in Google Pay hinterlegten Zahlungsinformationen in Form einer einmalig vergebenen Transaktionsnummer an die Ausgangswebsite, mit der eine erfolgte Zahlung verifiziert wird. Diese Transaktionsnummer enthält keinerlei Informationen zu den realen Zahldaten Ihrer bei Google Pay hinterlegten Zahlungsmittel, sondern wird als einmalig gültiger numerischer Token erstellt und übermittelt. Bei sämtlichen Transaktionen über Google Pay tritt Google lediglich als Vermittler zur Abwicklung des Bezahlvorgangs auf. Die Durchführung der Transaktion erfolgt ausschließlich im Verhältnis zwischen dem Nutzer und der Ausgangswebsite durch Belastung des bei Google Pay hinterlegten Zahlungsmittels.

      Sofern bei den beschriebenen Übermittlungen personenbezogene Daten verarbeitet werden, erfolgt die Verarbeitung ausschließlich zum Zwecke der Zahlungsabwicklung gemäß Art. 6 Abs. 1 lit. b DSGVO.

      Google behält sich vor, bei jeder über Google Pay getätigten Transaktion bestimmte vorgangsspezifische Informationen zu erheben, zu speichern und auszuwerten. Hierzu gehören Datum, Uhrzeit und Betrag der Transaktion, Händlerstandort und -beschreibung, eine vom Händler bereitgestellte Beschreibung der gekauften Waren oder Dienste, Fotos, die Sie der Transaktion beigefügt haben, der Name und die E-Mail-Adresse des Verkäufers und Käufers bzw. des Absenders und Empfängers, die verwendete Zahlungsmethode, Ihre Beschreibung für den Grund der Transaktion sowie gegebenenfalls das mit der Transaktion verbundene Angebot.

      Laut Google erfolgt diese Verarbeitung ausschließlich gemäß Art. 6 Abs.1 lit. f DSGVO auf Basis des berechtigten Interesses an der ordnungsgemäßen Rechnungslegung, der Verifizierung von Vorgangsdaten und der Optimierung und Funktionserhaltung des Google Pay-Dienstes.

      Google behält sich außerdem vor, die verarbeiteten Vorgangsdaten mit weiteren Informationen zusammenzuführen, die bei der Nutzung weiterer Google-Dienste durch Google erhoben und gespeichert werden.

      2.4 Klarna

      Bei Auswahl einer Klarna-Zahlungsdienstleistung erfolgt die Zahlungsabwicklung über die Klarna Bank AB (publ) [https://www.klarna.com/de], Sveavägen 46, 111 34 Stockholm, Schweden (nachfolgend „Klarna“). By using this service, our location and, where applicable, retail partners where our products are available are displayed to you, making it easier to find us.

15 Rights of the data subject
  1. The applicable data protection law grants you comprehensive data subject rights (information and intervention rights) vis-à-vis the controller with regard to the processing of your personal data, about which we inform you below:
    • Right to information in accordance with Art. 15 GDPR: In particular, you have the right to information about your personal data processed by us, the purposes of processing, the categories of personal data processed, the recipients or categories of recipients to whom your data has been or will be disclosed, the planned storage period or the criteria for determining the storage period, the existence of a right to rectification, erasure, restriction of processing, objection to processing, complaint to a supervisory authority, the origin of your data if it was not collected by us from you, the existence of automated decision-making including profiling and, if applicable, meaningful information on the logic involved and the scope and intended effects of such processing on you, as well as your right to be informed of the guarantees pursuant to Art. 46 GDPR if your data is transferred to third countries;

    • Right to withdraw consent granted in accordance with Art. 7 (3) GDPR: You have the right to withdraw your consent to the processing of data at any time with effect for the future. In the event of revocation, we will delete the data concerned immediately, unless further processing can be based on a legal basis for processing without consent. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal;
    • Right to lodge a complaint pursuant to Art. 77 GDPR: If you consider that the processing of personal data relating to you infringes the GDPR, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement, without prejudice to any other administrative or judicial remedy.

2. Right to Object

If we process your personal data based on a balancing of interests due to our overriding legitimate interest, you have the right at any time to object to this processing with effect for the future on grounds relating to your particular situation.

If you exercise your right to object, we will cease processing the data in question. However, we reserve the right to continue processing if we can demonstrate compelling legitimate grounds for the processing that override your interests, fundamental rights, and freedoms, or if the processing serves to assert, exercise, or defend legal claims.

If we process your personal data for direct marketing purposes, you have the right to object at any time to the processing of your personal data for such marketing purposes. You may exercise this right as described above.

If you exercise your right to object, we will cease processing the relevant data for direct marketing purposes.



16. duration of the storage of personal data

The duration of the storage of personal data is determined by the respective legal basis, the purpose of processing and - if relevant - additionally by the respective statutory retention period (e.g. retention periods under commercial and tax law).

When processing personal data on the basis of express consent in accordance with Art. 6 para. 1 lit. a GDPR, this data is stored until the data subject withdraws their consent.

If there are statutory retention periods for data that is processed in the context of legal or similar obligations on the basis of Art. 6 para. 1 lit. b GDPR, this data will be routinely deleted after expiry of the retention periods, provided that it is no longer required for contract fulfillment or contract initiation and/or we have no legitimate interest in further storage.

When processing personal data on the basis of Art. 6 para. 1 lit. f GDPR, this data is stored until the data subject exercises his or her right to object in accordance with Art. 21 (1) GDPR, unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defense of legal claims.

When processing personal data for the purpose of direct marketing on the basis of Art. 6 (1) lit. f GDPR, this data is stored until the data subject exercises their right to object in accordance with Art. 21 para. 2 GDPR.

Unless otherwise stated in the other information in this declaration on specific processing situations, stored personal data is deleted when it is no longer necessary for the purposes for which it was collected or otherwise processed.

18. amendment of this privacy policy

We reserve the right to amend the privacy policy in order to adapt it to changed legal situations or in the event of changes to the service and data processing.
