1. scope of application

    1. Business transactions and deliveries are carried out exclusively in accordance with the following General Terms and Conditions (GTC). These apply to all orders placed via our online store by consumers and entrepreneurs.
      A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside his trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, is acting in the exercise of their commercial or independent professional activity.
    2. Any terms and conditions of the customer that conflict with or deviate from the following GTC shall not apply.
    3. All information you provide during the ordering process must be current and truthful.
    4. If working days are specified as deadlines, this means all weekdays with the exception of Saturdays, Sundays and public holidays.
    5. Depending on the seller's product description, the subject of the contract may be both the purchase of goods by way of a one-off delivery and the purchase of goods by way of a permanent delivery (hereinafter "subscription contract"). In the case of a subscription contract, the seller undertakes to deliver the contractually owed goods to the customer for the duration of the agreed contract term at the contractually owed time intervals.

2. contract text storage

    1. KoKue saves the text of the contract and sends the order data by e-mail. Orders can be viewed in the customer account, if one has been created. If no customer account exists, the contract data is no longer accessible on the Internet for security reasons.
    2. These GTC can be viewed, printed and saved at any time at www.prettynamnam.de/agb. In addition, KoKue will send the GTC (as well as the cancellation policy) as an attached and printable PDF with the order details by e-mail to the customer after completion of the order.
3. conclusion of contract/supply reservation
    1. The presentation of the products on www.prettynamnam.de does not constitute a legally binding offer, but a non-binding online catalog. By clicking on the "Buy" button at the end of the order process, a binding order is placed for the goods in the shopping cart. Once the order has been placed, KoKue will send an e-mail confirming receipt of the order. This e-mail is only a confirmation of receipt and does not constitute acceptance of the order. The time at which the contract is concluded with us depends on the payment method you have chosen:
      PayPal:
      During the ordering process, you will be redirected to the website of the online provider PayPal. Here you can enter your payment details and confirm the payment instruction to PayPal. After placing the order in the store, we request PayPal to initiate the payment transaction and thereby accept your offer.
      Credit card:
      When placing the order, you enter your credit card details. After you have been legitimized as the legitimate cardholder, the payment transaction will be carried out automatically and your card will be charged.
      Apple Pay/Google Pay:
      After placing the order, you will be redirected to the website of the payment service provider STRIPE. There you confirm the payment instruction by entering your Apple ID / Google account information and the corresponding registration / payment data. Based on this, the contract with us is concluded. Payment is made to Stripe, Inc. 510 Townsend Street, San Francisco, CA 94103, USA.
      Shopify Payments:
      If you select a payment method offered via the "Shopify Payments" payment service, payment is processed via the payment service provider Stripe Payments Europe Ltd, 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland (hereinafter "Stripe"). The individual payment methods offered via Shopify Payments are communicated to the customer in the seller's online store. Stripe may use other payment services to process payments, for which special payment terms may apply, to which the customer may be informed separately. Further information on "Shopify Payments" is available on the Internet at https://www.shopify.com/legal/terms-payments-de.

    2. Our database is constantly updated to ensure the availability of the products offered on www.prettynamnam.de. KoKue is entitled to withdraw from the purchase contract if KoKue itself was not supplied correctly and on time despite a proper congruent covering transaction, is not responsible for the lack of availability and no procurement risk was assumed by KoKue. KoKue undertakes to inform itself immediately of any unavailability and in this case to refund any advance payment made without delay.

4. payment, shipping and price

    1. The available payment methods are displayed both in the footer of the homepage and on the separate "Payment & Shipping" page. Unfortunately, it is not possible to pay by sending cash or checks.
    2. If there are any chargebacks or other payment reversals on the customer side and this occurs without justification, the customer shall bear the costs incurred.
    3. All prices on www.prettynamnam.de are in euros and include the statutory value added tax. Shipping and packaging costs will be added as shown individually. Any customs duties and other costs incurred for deliveries to countries outside the EU must be borne by the customer in such cases.
    4. If an order is placed in several deliveries, KoKue will only charge the shipping costs once.

5 Duration and termination of subscription contracts

    1. Subscription contracts are concluded for an indefinite period and can be terminated by the customer at any time without notice.
    2. The right to extraordinary termination for good cause remains unaffected. Good cause shall be deemed to exist if the terminating party cannot reasonably be expected to continue the contractual relationship until the agreed termination or until the expiry of a notice period, taking into account all circumstances of the individual case and weighing the interests of both parties.
    3. Cancellations can be made in writing, in text form (e.g. by e-mail) or in electronic form via the cancellation facility provided by the seller on its website (cancellation button).

6. reservation of title

The goods remain the property of KoKue until full payment has been received.
If the seller makes advance payment, he shall retain title to the delivered goods until the purchase price owed has been paid in full.
 
7. redemption of promotional vouchers & discount codes
    1. Vouchers that are issued free of charge by the seller as part of promotional campaigns with a specific period of validity and that cannot be purchased by the customer (hereinafter "promotional vouchers") can only be redeemed in the seller's online store and only during the specified period.
    2. Promotional vouchers can only be redeemed by consumers.
    3. Individual products may be excluded from the voucher promotion if a corresponding restriction results from the content of the promotional voucher.
    4. Promotional vouchers can only be redeemed before completing the order process. Subsequent offsetting is not possible.
    5. Only one promotional voucher can be redeemed per order.
    6. When using a voucher or discount code, the minimum order value communicated on the website continues to apply. The goods value of an order is calculated after deduction of vouchers and/or discount codes - it must therefore still be equal to or above any minimum order value even after deduction. The same applies to the amount for any exemption from shipping costs - this must be reached or exceeded even after any discounts have been deducted.
    7. The value of the goods must be at least equal to the amount of the promotional voucher. Any remaining credit will not be refunded by the seller.
    8. If the value of the promotional voucher is not sufficient to cover the order, one of the other payment methods offered by the seller can be selected to settle the difference.
    9. The balance of a promotional voucher is neither paid out in cash nor does it bear interest.
    10. The promotional voucher will not be refunded if the customer returns the goods paid for in full or in part with the promotional voucher within the scope of their statutory right of withdrawal.
    11. The promotional voucher is transferable. The seller can make payment with discharging effect to the respective holder who redeems the promotional voucher in the seller's online store. This does not apply if the seller has knowledge or grossly negligent ignorance of the non-authorization, legal incapacity or lack of power of representation of the respective holder.

8. redemption of gift vouchers

    1. Vouchers that are purchased via the seller's online store (hereinafter "gift vouchers") can only be redeemed in the seller's online store, unless otherwise stated in the voucher.
    2. Gift vouchers and remaining credit on gift vouchers can be redeemed until the end of the third year after the year in which the voucher was purchased. Remaining credit will be credited to the customer until the expiration date.
    3. Gift vouchers can only be redeemed before completing the order process. Subsequent offsetting is not possible.
    4. Only one gift voucher can be redeemed per order.
    5. Gift vouchers can only be used for the purchase of goods and not for the purchase of further gift vouchers.
    6. If the value of the gift voucher is not sufficient to cover the order, one of the other payment methods offered by the seller can be selected to settle the difference.
    7. The balance of a gift voucher is neither paid out in cash nor does it bear interest.
    8. The gift voucher is transferable. The seller may make payment with discharging effect to the respective holder who redeems the gift voucher in the seller's online store. This does not apply if the seller has knowledge or grossly negligent ignorance of the non-authorization, legal incapacity or lack of power of representation of the respective holder.
9. invoicing

Each customer will receive an invoice immediately after ordering via email to the email address provided.

10. right of withdrawal

    1. Consumers are generally entitled to a right of withdrawal.
    2. Further information on the right of withdrawal can be found in the seller's withdrawal policy - see www.prettynamnam.de/widerrufsbelehrung
    3. If the customer cancels the order before the ordered products have been delivered, KoKue is entitled to charge a cancellation fee of €5 (in words: five euros). This cancellation fee represents administrative and bank service costs as well as packaging costs already incurred.

11 Delivery and shipping conditions

    1. Unless otherwise agreed, the goods shall be shipped to the delivery address specified by the customer. The delivery address specified in the seller's order processing is decisive for the processing of the transaction.
    2. If the delivery of the goods fails for reasons for which the customer is responsible, the customer shall bear the reasonable costs incurred by the seller as a result. This does not apply with regard to the costs for the return shipment if the customer effectively exercises his right of withdrawal. If the customer effectively exercises his right of revocation, the provision made in the seller's revocation instructions shall apply to the return costs.
    3. Self-collection is not possible for logistical reasons.

12. transportation damage

    1. KoKue assumes the transportation risk. In the event that ordered goods arrive damaged during transportation, the customer should complain to the delivery company as soon as possible and contact KoKue. Failure to file a complaint with the shipping service provider has no consequences for the Customer's legal claims and their enforcement, in particular warranty rights. However, such a process helps KoKue to assert the claims against the shipping service provider, i.e. the carrier or the transport insurance company.
    2. You can either contact us by e-mail at hi@prettynamnam.de. Providing an order number and other order details can speed up this process.

13. warranty/ notification of defects

    1. The statutory warranty rights for goods apply.
    2. Obvious defects in the goods should be reported immediately, but at the latest within two (2) weeks of delivery of the goods, using the contact channels specified above.
    3. KoKue focuses on support and customer satisfaction in general. Defect reports or other concerns will therefore be checked as quickly as possible and the customer will be contacted immediately in order to clarify the matter. If defects have been reported to us by e-mail, but you as a customer have not received a response after 5 working days, we apologize and ask you to contact us again - in rare cases an e-mail may have been "caught" in the spam filter (by us or the customer) or it may happen that an e-mail has not arrived at KoKue in some other way. Consumer rights in the event of a defect are not restricted by this.

14. final provisions

    1. The place of jurisdiction for all legal disputes arising from the contractual relationship is the place of business of the Seller (KoKue), insofar as the Buyer is to be regarded as an entrepreneur.
    2. The contract language is German.

15. severability clause

Should individual provisions of the contract, including these provisions, be or become invalid in whole or in part, or should the contract contain an unforeseen loophole, the validity of the remaining provisions or parts of such provisions shall remain unaffected. The invalid or missing provisions shall be replaced by the respective statutory provisions.

16. code of conduct

    1. The seller has submitted to the conditions of participation for the eCommerce initiative "Fairness in Commerce", which can be viewed on the Internet at https://www.fairness-im-handel.de/teilnahmebedingungen/.
    2. The seller has submitted to the guidelines for "Google Customer Reviews", which can be viewed on the Internet at https://support.google.com/merchants/topic/7105962.

17 Alternative dispute resolution

    1. The EU Commission provides a platform for online dispute resolution on the Internet at the following link: https://ec.europa.eu/consumers/odr
    2. This platform serves as a contact point for the out-of-court settlement of disputes arising from online purchase or service contracts in which a consumer is involved.
    3. The seller is not obliged to participate in a dispute settlement procedure before a consumer arbitration board, but is generally prepared to do so.
